The terms you agree to when you shop with us: how an order is made, what we promise, and what we ask of you. Written to be read, not to be waded through.

Your rights stand

Nothing in these terms limits the consumer rights you already have.

An order is accepted once we dispatch it, not when you pay.

Changes

If we update these terms, the new version appears on this page.

Who we are

This store is operated by Undiesmith Pty Ltd (ABN 34 696 371 169), an Australian company. Where these terms say “we”, “us” or “Undiesmith”, they mean Undiesmith Pty Ltd.

About these terms

These terms apply when you browse our store, create an account or place an order with us. By doing any of those things, you accept them.

Our privacy policy, shipping policy and returns policy form part of these terms. Where a specific policy covers something in more detail, that policy applies.

Placing an order

When you place an order you’re making an offer to buy. We accept that offer when we dispatch your order, and that’s when a contract between us is formed. The confirmation email you get at checkout acknowledges your order; it isn’t our acceptance of it.

We may decline or cancel an order before dispatch, including where an item is out of stock, where we can’t verify your payment or delivery details, or where an order looks fraudulent or is for commercial resale. If we cancel an order you’ve paid for, we refund it in full.

Prices and payment

Prices are shown in the currency of the market you’re shopping in and include any taxes shown at checkout. Delivery costs, where they apply, are shown before you pay.

We take reasonable care with pricing, but if an item is listed at an obviously incorrect price, we’ll contact you before dispatch and give you the choice of confirming at the correct price or cancelling for a full refund.

Payments are processed by our payment providers, not by us. We never see or store your full card details.

Delivery

Delivery timeframes, costs and what happens to a lost or damaged parcel are set out in our shipping policy. Delivery estimates are carrier estimates, not guarantees.

Risk in the goods passes to you on delivery.

Returns, exchanges and the guarantee

Our returns policy covers the 60-day money back guarantee on your first pair, size exchanges, and returning unworn pairs. For hygiene reasons we can’t accept worn pairs back, apart from the first pair covered by the guarantee.

These arrangements are in addition to your rights under the Australian Consumer Law, and nothing in them limits those rights.

Products, colours and sizing

We photograph our products as faithfully as we can, but screens vary, and the colour you see may differ slightly from the pair you receive.

Measurements in our size guide are approximate and are there to help you choose. If a pair doesn’t fit, our returns policy covers an exchange.

Your account

If you create an account, please keep your details accurate and your password to yourself. You’re responsible for what happens under your account until you tell us it’s been compromised.

We may suspend or close an account that’s being used to break these terms.

Using our store

Please don’t misuse the store. That includes interfering with how it works or its security, scraping or copying it systematically, or using it to break the law.

Buying from us is for personal use. If you’d like to stock Undiesmith, our wholesale page is the place to start.

Our brand and content

The Undiesmith name, logo, product photography, illustrations and written content on this store belong to us or are used with permission. You’re welcome to share links and posts about us, but please don’t reproduce our content for commercial purposes without asking first.

Consumer guarantees and liability

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those rights.

To the extent the law allows, and apart from those guarantees, our liability for any claim connected with a product or with this store is limited to replacing the goods or refunding what you paid for them. We aren’t liable for indirect or consequential loss.

What we collect, why we collect it and who we share it with are set out in our privacy policy.

Changes to these terms

We may update these terms as the business changes. The version on this page is the one that applies, and the date it was last updated is shown at the top. The terms that apply to your order are the ones published when you placed it.

Governing law

These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts able to hear appeals from them.

If you’re shopping from outside Australia, you may also have rights under the consumer law where you live, and this clause doesn’t take those away.
